Standard Terms and Conditions of acceptance of advertisements of Purple Ash Media, owners and publishers of THE LANDSCAPER. These conditions apply to all advertisements, insets, inserts, sponsored articles or features (“advertisements”) accepted for inclusion in hard copy editions of publications published by Purple Ash Media.

1. Scope of Terms These conditions apply to all advertisements accepted for inclusion in hard copy editions of publications published by Purple Ash Media. Any other proposed condition shall be void unless incorporated clearly in written instructions and specifically accepted by Purple Ash Media. These terms do not apply to advertisements placed in digital or electronic editions of Purple Ash Media publications.
2. Acceptance of Advertisements All advertisements are accepted subject to Purple Ash Media’s approval of the copy and the availability of space.
3. Competitions and Special Promotions If an advertisement includes a competition or special merchandise offer not normally associated with the advertised product, full details must be submitted at the time of booking.
4. Right to Omit or Suspend Advertisements Purple Ash Media reserves the right to omit or suspend an advertisement at any time for good reason. In such cases no claim for damages or breach of contract shall arise. If the omission or suspension results from the act or default of the Advertiser or its agents, the reserved advertising space shall still be paid in full. The Advertiser will be notified as soon as possible.
5. Changes to Advertisement Placement If Purple Ash Media finds it necessary to modify the space, change the insertion date or position, or make other alterations, the Advertiser may cancel if the changes are unacceptable unless they result from emergencies or circumstances beyond Purple Ash Media’s control. Purple Ash Media accepts no liability for losses arising from late appearance or non-publication.
6. Advertiser Warranty The Advertiser warrants that the advertisement:
   • Is not illegal or defamatory
   • Does not infringe the rights of any third party
   • Complies with the British Code of Advertising Practice
   Where applicable, the country of origin (other than the United Kingdom) of goods advertised must be clearly stated to comply with legal requirements.
7. Indemnity The Advertiser shall fully indemnify Purple Ash Media against any claims arising from the advertisement. Purple Ash Media will consult the Advertiser on how such claims are handled.
8. Advertisement Rates Advertisement rates may be revised at any time. Orders are accepted on the condition that the agreed price applies only to the next issue going to press. If rates increase, the Advertiser may cancel the order without surcharge or continue at the revised rate.
9. Cancellation of Advertisement Programs If the Advertiser cancels the remaining balance of an agreed advertisement program (except under clauses 5 or 8), any previously agreed series discount will be withdrawn and all advertisements will be charged at the standard rate card price.
10. Series Advertisement Discounts Discounted rates for advertisement series apply only if the series is completed within 12 months of the first insertion. Failure to do so will result in all advertisements being charged at the applicable rate card rates.
11. Payment Terms Accounts must be settled within 30 days of the invoice due date. Purple Ash Media reserves the right to suspend advertising insertions and reduce agency commission for overdue accounts. Interest may be charged at the maximum rate permitted by law.All display advertising rates are subject to the Advertising Standards Board of Finance surcharge. If an Advertising Agent places the order, the Agent must collect and remit this surcharge to the Board. If the Advertiser places advertising directly, Incisive Media will invoice and distribute the surcharge to the Board.
12. Additional Costs Purple Ash Media reserves the right to recover any additional costs resulting from the acts or defaults of the Advertiser or its Agent.
13. Complaints Complaints regarding the publication of advertisements must be submitted in writing within one calendar month of the cover date.
14. Cancellation Deadlines A minimum of two weeks’ written notice prior to the copy date is required to stop, cancel, or suspend an advertisement insertion. After this deadline the Advertiser will be liable to pay the full rate.
15. Late Copy Instructions If copy instructions are not received by the agreed copy date, proofs may not be supplied and corrections may not be possible. Purple Ash Media reserves the right to repeat the most appropriate previously supplied copy.
16. Advertiser Materials Advertiser property including artwork, photographs, and other materials are held at the Advertiser’s risk. Materials may be returned via Royal Mail upon request at the owner’s risk. Purple Ash Media reserves the right to destroy materials held for more than 12 months since their last appearance.
17. Definition of Advertiser For the purposes of these conditions, “Advertiser” refers to the Advertiser or its Agent, whichever is the principal. “Advertisement” includes loose inserts or other insets where appropriate.
18. Governing Law These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall fall under the exclusive jurisdiction of the English courts.
19. Data Protection Purple Ash Media will not store credit card details nor share customer details with any third parties.
20. Refund Policy Purple Ash Media will refund within 30 days any monies paid by the Advertiser if the advertisement is not published due to the fault or omission of Purple Ash Media.
